General

Our terms should be read in conjunction with the law of Ghana and in particular, law of contract. The wording contained herein represents an offer to treat. Your acceptance of our terms of business is performed when successful payment is made in favour of move in move out, how so ever made.

No liability is accepted or should be seen as being implied in so far as third parties employed by move in move out and their actions or inactions. Nor should any liability be assumed in so far as move in move out supplied goods, such as for sale materials, being used inappropriately by third parties and causing damage to property. No liability is accepted by move in move out in any respect whatsoever where circumstances beyond its control may lead to any loss or inconvenience.

 

Jurisdiction for use

This site is intended for use only by those who can access it from within Ghana. This site is subject to Ghana regulatory regime and is therefore restricted to consumers based in Ghana.

 

Governing law

This site is governed by the laws of the country of Ghana within which you reside and any dispute or action arising out of this site shall be determined in accordance with such laws.

 

Changes

Fee Options and Policy

Option 1 – PAY NOW Property Seller Package:

The PAY NOW $500 upfront fee with nothing to pay on completion property seller package applies to a marketing period for a maximum of twelve (12) months from instruction however once the twelve (12) months has elapsed move in move out may continue to market your property indefinitely and/or until the client removes their property from sale however the limit of DCANS Properties’ liability is twelve (12) months from the date of instruction and further advice, guidance and text and graphical alterations to a property’s listing details will cease. Additional fees are due from time to time if any optional extras are required. There is no tie in period or sole agency requirement.

You will be liable to pay the full fee to us, in addition to any other expenses or charges agreed, within 7 days of signing the sales agreement if you enter into the PAY NOW property seller package and prior to the marketing of your property regardless if there is unconditional exchange of contracts for the sale of the property. No refund of any fees will be available once payment has been made to DCANS Properties Limited.

PLEASE REMEMBER IF YOU HAVE INSTRUCTED ANOTHER AGENT TO SELL YOUR PROPERTY ON A SOLE AGENCY/SOLE SELLING RIGHTS BASIS, YOU MAY BE LIABLE TO PAY THEIR FEE AS WELL AS OURS.

 

Option 2 – NO SALE NO FEE Property Seller Package:

The NO SALE NO FEE with NO UPFRONT FEES and $1,900 to pay only when sold on completion property seller package applies to a marketing period for a maximum of twelve (12) months from instruction however once the twelve (12) months has elapsed move in move out may continue to market your property indefinitely and/or until the client removes their property from sale however the limit of move in move out’s liability is twelve (12) months from the date of instruction and further advice, guidance and text and graphical alterations to a property’s listing details will cease. Additional fees are due from time to time if any optional extras are required. There is a minimum tie in period of 26 weeks from initial instruction subject to a 4 week notice period, which must be provided in writing. There is no sole agency requirement.

You will be liable to pay the full home seller fee to us, in addition to any other expenses or charges agreed, if you enter into the NO SALE NO FEE property seller package, if there is unconditional exchange of contracts for the sale of the property. Any buyer that is introduced by us during the 26 week tie in period on the NO SALE NO FEE property seller package or with whom we have had negotiations about your property during that period, will result in you being liable for payment of the full fee and any additional expenses, if any such party agrees to purchase your property unless written notice of termination has been received 4 weeks prior to any subsequent exchange of contracts.

The home seller fee shall be paid on completion or paid on demand following exchange within 14 days. On exchange of contracts we will send our fee invoice direct to the vendors solicitor/conveyancer for settlement from the proceeds of the sale. Where an invoice in unpaid for 30 days or more from the date of sale, we reserve the right to charge interest plus an admin fee of $50 +VAT.

You will be liable to pay a withdrawal fee of up to 50% of the home seller fee, if the property is withdrawn from sale at any time and for any reason, including the sale of the property by another estate agent, during the 26 week tie in period other than the sale of the property by move in move out. Any withdrawal fee shall be paid on demand and within 14 days of request.

Accompanied Viewings Package

Our optional accompanied viewings package will include unlimited number of accompanied viewings or accompanied visits for al packages except no upfront fee packages which comes at a cost of $200.

 

Termination of Agency

The agreement may be terminated by either party giving 14 days notice in writing to the correspondence address. After the expiry of the 14 days, we will cease to market your property. You may be liable to pay any agreed expenses/fees and/or a withdrawal fee within 14 days.

 

Other Services

Unless otherwise specified, we reserve the right to offer other services to prospective purchasers.

 

Offers

Where offers are received from a prospective purchaser, we will normally ensure the buyer has the ability to proceed with a successful sale. The vendor will be advised of all offers received. Offers may be reported to the vendor by telephone or email as soon as it is practically possible. No offer will be accepted without the prior approval from the vendor.

 

Definitions

A sale is the proceeding of a third party with a purchase of the instructed property in question which was subject to the involvement of move in move out in any way.

A viewing appointment, whether actually carried out or not, a negotiated offer or an involvement by way of DCANS Properties' substantive communication with the party that subsequently purchased, will be deemed as ‘involvement’. Merely emailing or sending a set of details will not be constituted as substantive communication however a regular contact over the same property would be.

DCANS Properties does not operate sole agency agreements. There are no contractual time period tie ins. You are free to instruct any or as many alternative or additional estate agents in conjunction with the move in move out service as you wish. No notice of this is required except in the event that you wish to take advantage of any Money Back Guarantee offer that may exist from time to time and whereby you must advise us if and when other estate agents are instructed.

 

Property Information

The selling customer will verify information displayed by DCANS Properties in relation to their property and will advise DCANS Properties of any inaccuracies. Any material changes which may affect a property’s description post instruction must be informed to DCANS Properties by the selling customer.

 

Additional Services

DCANS Properties will offer its selling clients and prospective purchasers additional services such as but not limited to Floor plans, financial services including mortgages, insurances, pensions and investments, conveyancing from which DCANS Properties may derive a commission and/or a fee.

 

Disclaimer

When you transact with DCANS Properties you are agreeing to accept the terms of use set out below and any additional terms that may be located elsewhere that are brought to your attention. move in move out may change these terms without notice at any time, so you should revisit these and any other relevant pages, from time to time prior to further transactions to ascertain what terms of use you are agreeing to.

In respect of all home seller packages which necessitates an upfront payment of fees these services are provided and formally valid for a standard period of twelve (12) months from the date that such payment is made only. Thereafter marketing can continue if the customer so requires and will be at no further cost to them. However all upfront payments in this regard represent the twelve (12) month initial period only and no liability is accepted or implied with regard to continuity of marketing beyond the initial twelve (12) months whatsoever.

Refunds

Where an overpayment occurs a refund may be issued following a request. Where payment was initially made by debit/credit card via skrill, refunds for overpayment shall normally be applied back to the same card account. Where Internet payments require an authorised refund to be applied to the transaction, the payment will only be refunded to the card making the initial payment. Where a payment by any other means has been made to the company that payment is final and no refunds will be due for any reason. The company instigates various costs at the outset of a property being instructed to it and thus refunds will not be entertained where a customer changes their mind or is subject to a change of circumstances.

 

Security

The company provides secure online payments facility. Once you click on the link to make a payment you will be redirected to a fully hosted secure managed environment. The online service is fully managed externally and the company does not hold any card details on any of its servers or within its infrastructure. The company does not have any access to your card details on the managed service. The online payments system complies with all of the security requirements including CV2 input, Verified by Visa, MasterCard Secure Code etc and the company will continue to enhance the application to the highest security standards.

 

Limitation of Liability

DCANS Properties, its suppliers or other third parties mentioned on this site will not be liable for any damages arising out of the use, inability to use or results of use of this site, any web sites linked to this site or any material or information contained on this site.
